L. Milford Township on Quarry Challenge: It's Not Over

Lower Milford Township officials are letting residents know that their fight to uphold ordinances they believe prohibit a quarry in the township is far from over.

Although the company that wants to open a quarry in Lower Milford Township recently won a legal victory, township officials stressed recently that the battle to keep the quarry out of the township is far from over.

In a news update posted on the township website Aug. 31, staff tried to dispel misconceptions about the current status of the Geryville Materials Inc. quarry application.

"[Recent news] articles have made it appear that the quarry has won and only after going back to the planning commission, digging will begin. THIS IS NOT TRUE," the update states.

"The township has the right to file an appeal to the PA Supreme Court and it has. Until the Supreme Court makes a decision to listen to the case, or not, the quarry application at the planning commission level is on hold and the outcome could change depending on what happens in that court," it says. "Also, hearings at the Lower Milford Township Zoning Hearing Board must still be finished. Depending on the decision of the Zoning Hearing Board, additional court appeals could be filed."

Township officials also seek to dispel concerns about the cost of the legal battle in the update.

"Most of the cost to the taxpayers is done," it says. "And it was spread over the last 9 years with no tax increase...."

The Fall 2013 edition of the Lower Milford Township newsletter also features an update about the latest developments in the nine-year saga on its front page.
