Deely Doesn't Concede, Though House Dems Do

Citing 'too much support for a recount,' Democrat Kevin Deely refuses to concede 131st District race to incumbent Republican Justin Simmons. But Democratic Campaign Committee Chairman Brendan Boyle says 'not enough ballots to win.'

Is the race for the 131st state House seat over?

Depends on who you ask. 

Though Lehigh County's vote count shows incumbent Republican Justin  Simmons edged out Kevin Deely by 16 votes in Lehigh County, and the Simmons camp says the Northampton County vote count put Simmons ahead by another 432 votes, challenger Kevin Deely won't concede the race anytime soon.

"It's so close, we just want to make sure every vote is counted. I have so many supporters asking for a recount," said Deely in an exclusive interview. "I'm not conceding the race. There's only a little more than one percentage point [between Deely and Simmons], and the results will come soon enough. In the end, democracy will win."

Deely confirmed his campaign is "strongly considering" a recount.

A representative of the Simmons campaign released the following statement from the state representative: "Both campaigns had lawyers and representatives present as every vote was counted in Northampton and Lehigh County. The election is over."

According to a report Wednesday on Capitolwire.com, House Democratic Campaign Committee Chair Brendan Boyle agreed with the Simmons camp.

"It doesn't look like there are enough absentee ballots and provisional ballots in that race to win it for Deely," Boyle told Capitolwire.

Everyone is being too harsh. Mr. Deely isn't looking to or able to spend any public money on a recount so none of anyone's tax money will be wasted. If he raises private money to fund a recount that is high right under state law. If we don't like how the law is written we should ask the legislature to change it. But, at the moment it is the law governing elections in PA.

I'm a democrat who actually voted for Deely. Can I change my vote? Votes have been counted and there has been a winner. Why are we still hearing about this? Re-counts only make sense when there is evidence of tampering. This just seems like a waste of time and OUR money.

Come on people... Deely is a teacher.... they are a bunch of no class union wonks. When he doesn't get his way on the job, he gets to jump up and down an file a union grievance. He doesn't have to accept facts on the job, he can bring the union machine to his rescue. It's almost Thanksgiving, lets just be thankful we didn't end up with this idiot as our representative.

Why so much vitriole towards Mr. Deely? Mr. Simmons is the incumbent so he can carry on his life as a state legislator while a recount goes on without trouble. No state money will be spent. I'm not seeing why everyone needs to bash Mr. Deely for exercising his rights under state law as a candidate. Is it likely Mr. Deely will win in the end? No. But, he has a right to fund a recount if he wants to with private money. Since it doesn't affect anyone's lives, why does everyone care so much? And yes I did actually call Mr. Mackenzie to conceed on election night. He didn't take my call and then called me back an hour later. I offered him well wishes on making PA a better state and he thanked me for offering the voters a choice. Its not the end of the world to call and conceed so I'm sure Kevin can do it if he feels its right.

He's not wasting anyone's time who doesn't choose to waste it (here on patch and elsewhere). Why so angry at him? He has a right to pay for a recount if he wants. No public money will be used. The state will not wait to seat Mr. Simmons. How is anyone hurt?

Do you really think $50 per precinct really covers the cost? Maybe everyone else on the ballot should ask for a recount too? Think what a cluster that would cause.

The law should be rewritten if it doesn't cover costs. Perhaps something for Mr. Simmons to do once he's back in Harrisburg. I'm not encouraging anyone to ask for a recount. I'm just pointing out that Mr. Deely is doing nothing against the law. Pennsylvania has very detailed laws on these things and Gov. Corbett and the legislature recently changed a number of things to clean up elections (voter ID among others) so this is their own oversight that they didn't clean up the recount laws. I'd like the law to read a deposit of $50/precinct with the balance of costs to be paid by the petitioner if the recount finds nothing that would alter the outcome.

Ah how I wish the debates mattered. Mackenzie did little better than Deely did in the debates. Based on contact with attendees afterwards I would have won by a fair margin if the people who saw them live were the voters and one of those groups was the Chamber of Commerce not exactly the teachers union in its political leanings. I'm done as I have a consulting job to get back to. I just think the anger is improperly placed at Mr. Deely when he hasn't done anything wrong here. There is no requirement to conceed, just ask Allen West.

Why not concede and donate the "private" money for the recount to the Red Cross for those affected by hurricane Sandy, or does Mr. Deely feel a need to persist in his selfish delusion. He is not the person that I would want to allocate my tax money, ever.

I am a proud supporter of both Ryan MacKenzie and Justin Simmons. I was glad to see them both win. Ryan convincingly, and Justin by a whisker. That being said, I have no problem with Mr. Deely exercising his rights to a re-count. He has to raise the money for it and it is within his rights to ask for it. It doesn't matter if I think it is worthwhile or not. I think it is in the best of transparency to the public if it happens. Afterwards, there will be no question as the who the winner was.

Reynard....when a fraud like Deely pulls stunts like these yes it angers people.That carpetbagging pot smoking union hack may have the right for a recount but when the Democratic chair knows that they are no votes to find and calls it quits so should he! By the way..it is common courtesy and professionalism for the loser to call the winner. Saying that Deely will call Simmons if he thinks its RIGHT????Who the hell is Kevin Deely !!!!He has never won anything . If he doesnt call Rep Simmons it will prove yet again. that Simmons was/ is the better man. By the way...How about that Simmons beating the Obama machine !

In my personal opinion , Deely should give up his teaching position too. It seems from being around young people so much , he is acting like them (childish). I wish for Deely to stop making a complete fool of himself -show these kids you are a man not a moron. For Representative Justin Simmos...I wish you the best. Mr.Simmons is by far the better man.The juvenile behavior displayed by Delly says it all.

Mr. Reynard..on another note,...Thank you for clarifying in your PBS Televised debate with Ryan McKenzie that it was Ed Rendell's administration that pulled the 1.2 B out of the State Budget knowing the stimulus $$ were going to end therefore creating the huge gap that the current administration had to fill. Guess Mr. Deely didn't get the message ? Mr. Deely Lied to the public, in his flyers, On TV , In the debates that Mr. Simmons cut educational spending which is a flat out lie Maybe now you understand why all the vitriole against your union hack associate?

I apologize for that. You see, I attended Saucon Valley School District and they are not up to standards. On a side note- this isn't about me-this is about Deely. I didn't run for office . Mr.Deely ran and lost. Talk about horrendous...he can't accept he's a loser.
