Ex-DeSales Employee Convicted of Spying Resentenced to Probation

An ex-Desales University employee who was convicted of spying on a lactating co-worker and sentenced to nine to 21 months in county prison last year was resentenced Wednesday to three years of probation.

An ex-Desales University employee who was convicted of spying on a lactating co-worker and sentenced to nine to 21 months in county prison last year was resentenced Wednesday to three years of probation and 15 years of registration on Pennsylvania's Megan's Law list, the Express-Times reported.

John Bednarik II, of Blandon, Berks County, and formerly of Bethlehem, appealed his sentence to Pennsylvania's Superior Court, which ultimately ruled that Lehigh County Judge James Anthony made a mistake when he cited Bednarik's Catholic background as a reason for imposing an aggravated sentence of prison time, the newspaper also reported.

Bednarik was working as DeSales' director of campus environment when he was arrested for using a video recorder to spy on a colleague who was pumping breast milk. He was later fired by the Upper Saucon Township school.
